ABOUT MEDIATION

WHAT KIND OF DISPUTES CAN BE RESOLVED THROUGH MEDIATION?

  • Subject of mediation can be civil, commercial, labor, family and administrative disputes, consumer rights related disputes, as well as any other disputes between natural persons and/or legal entities. – Art.3 MA.
  • Mediation has significant effect in cases of commercial and contractual disputes, real estate and construction disputes, personal injury disputes, intellectual property disputes, insurance disputes, and labor disputes.

When Is Mediation Appropriate?

Mediation can be utilized when the following factors are present:

  • a desire not to spend large sums on legal fees;
  • when the parties have been negotiating, but they are still at an impasse;
  • when there is disagreement about the value involved in the legal matter;
  • when both parties really want third party' assistance for the resolution of the disputable issues;
  • when a quicker resolution is desired, or required;
  • when a confidential settlement is desired
  • when parties desire to continue their business relations.

When Is Mediation Not Appropriate?

Mediation may not be appropriate when some of the following factors are present:

  • where there is an outright refusal of the parties to consider any resolution or compromise;
  • where the parties want to embarrass the others in a public forum, or to call attention to the lawsuit;
  • when the parties actually want a third party to decide the outcome for them;
  • where a quick resolution is not desired (where, for example, it is to one party's advantage to delay any resolution for monetary reasons);
  • where principle is being determined.

What kind of disputes can be referred for resolution to the Mediation Center with the Court of Arbitration at the BCCI?

  1. Commercial Dispute - corporate dispute (disputes between shareholders, dispute concerning management and representation of a commercial entity), disputes arising out of commercial transactions, related to securities.
  2. Contractual Disputes, arising out of Sale Contract, Delivery Contract, Lease Contract, Service Contract, Loan Contract, Manufacture Contract, etc.
