ABOUT MEDIATION

WHEN AND HOW TO START A MEDIATION PROCEDURE?

  • Mediation can be held at each stage of a dispute.
  • It is recommendable to refer your dispute to mediation promptly after the dispute arises in order to avoid an escalation of conflict, and prior to referring dispute to the court, if possible.
  • A proposal for resolution of the dispute through mediation can be made by:
    • either party or both parties in dispute,
    • court or another competent authority to which the dispute has been referred for resolution.
  • The agreement of the parties that a possible future dispute between them could be resolved through mediation can be also stipulated as a provision in a contract.

Recommended clause

„All disputes, arising out of or in connection with this contract, shall be resolved through mediation conducted by a mediator at the Mediation Center with the Court of Arbitration at the Bulgarian Chamber of Commerce and Industry in accordance with the Charter and Mediation Rules of the Mediation Center, and in case the parties fail to reach an agreement, the dispute shall be resolved by the Court of Arbitration with the Bulgarian Chamber of Commerce and Industry”.

Recommended Clause for Mediation and Arbitration

„All disputes, arising out of or in connection with this contract, shall be resolved through mediation conducted by a mediator at the Mediation Center with the Court of Arbitration at the Bulgarian Chamber of Commerce and Industry in accordance with the Charter and Mediation Rules of the Mediation Center, and in case parties fail to reach an agreement, the dispute shall be referred for resolution to the Court of Arbitration at the Bulgarian Chamber of Commerce and Industry in accordance with its Rules for Litigations, based on arbitration agreements”.

  • Refer your dispute to a mediator or a mediation center. They will establish contact with the other party, assist parties in choosing mediator with appropriate qualification and experience and organize the mediation procedure.
  • In order to refer a case for mediation to the Mediation Center with the Court of Arbitration at BCCI it is necessary to contact the Mediation Center and to submit a Request for Mediation, notwithstanding whether the other's party consent is present. In case the request for mediation is submitted by one of the parties, the Mediation Center contacts the other party and informs it about the submitted request and provides it with sufficient information about mediation and its advantages.
