FEE SCHEDULE

Fees and Expenses for Mediation

Article 1. The Parties shall pay a registration fee, a fee for conduction of mediation (“Mediation Fee”) and an expenses deposit, as well as all expenses related to mediation.

Registration Fee

Article 2. (1) The party or parties filing a request for mediation shall attach to the request a document proving payment of a non-refundable registration fee amounting to 50 BGN, which ensures starting of the preparatory activities for conduction of mediation in accordance with the Charter and Mediation Rules.

(2) The registration fee shall cover the administrative expenses for the initial processing of the request for mediation and for organization of the preparatory activities preceding conduction of mediation, the local mail and other expenses for the initial summons of parties, as well as the expenses for technical services, such as copying, printing, scanning of documents amounting up to 50 pages.

Mediation Fee

Article 3. The Mediation Fee shall include the administrative expenses of the Mediation Center for conduction of mediation, the mediator’s fee and expenses.

Fee Formation

Article 4. The Mediation Fee shall be determined based on hourly rates.

Amount of the Mediation Fee

Article 5. (1) The hourly rate for mediation applicable for disputes between citizens and disputes involving property interest not exceeding 20 000 BGN shall be 50 BGN.

(2) The hourly rate for mediation applicable for disputes, where at least one of the parties is a commercial entity, or disputes between citizens or disputes involving property interest exceeding 20 000 BGN, or disputes of particular legal and factual complexity (multiple parties, multiple receivables or claims), shall be 80 BGN.

(3) In case of participation of more than two parties in mediation, an additional fee amounting to 30% of the hourly rate for the respective type of dispute pursuant to Par. 1 and 2 shall be due for each additional party.

(4) In case of conduction of mediation by more than one mediator the amount of the Mediation fee shall be increased by 50% compared to the hourly rate for the respective type of dispute pursuant to Par. 1 and 2.

(5) An exception from the amount of the above fees shall be admitted only with regard to disputes involving insignificant interest or disputes of significant legal and factual complexity, with the consent of the mediator and on the grounds of a preliminary agreement between the Mediation Center and the Parties.

Payment of the Mediation Fee

Article 6. (1) In advance of the mediation procedure the parties will be charged an Initial Mediation Fee of at least three hours which is non-refundable once the mediation begins. The Initial Mediation Fee of three hours includes time spent on joint meetings, as well as individual meetings (caucuses) that the mediator may schedule with the parties.

(2) After the first three hours of the mediation the mediator in consultations with the parties will estimate the hours necessary to complete the mediation. The parties will pay in advance the mediation fee according to this estimation. If the prepaid fee exceeds the actual fee due, it shall be refunded to the parties.

Expenses Deposit

Article 7. (1) The expenses deposit is the amount, paid for the expenses, incurred in connection with the individual cases for summons and notices, serving papers, international mailings, additional technical services such as copying, printing, scanning, translation, secretary and other services, for issue of certificates etc.

(2) The amount of the expenses deposit shall be determined by the Mediation Center, communicated to the parties and paid by them promptly after consent of both parties for conduction of mediation is present and prior to conduction of mediation. Mediation shall be conducted after payment of the deposit.

(3) Subsequent estimation of expenses will be made by the Mediator in consultations with the parties as it becomes necessary during the mediation.The parties will pay in advance the expense fee according to this estimation.

(4) Upon termination of the mediation the parties will be required to pay any excess expenses not included in the estimation or the Mediation Center shall refund to parties the outstanding sum of deposit, if any.

Refund of the Mediation Fee in case of cancellation of mediation by the parties

Article 8. (1) In case of cancellation of mediation by a party or parties, communicated to the Mediation center at least 7 days prior to the scheduled mediation meeting, the full amount of the paid Mediation Fee shall be refunded to parties, together with the deposit paid, if any, excluding the amounts, already spent from the deposit for preparation of mediation.

(2) In case of cancellation of mediation by a party or parties, communicated to the Mediation Center at least 24 hours prior to the scheduled mediation meeting, 75% of the paid Mediation fee shall be refunded to parties, together with the outstanding part of the paid deposit, if any, but not exceeding 75% of the deposit.

Final Provisions

§ 1 The present Mediation Fee Schedule of the Mediation Center is adopted by the Executive Board of BCCI by Resolution No. 22/19-2005 dated 13.09.2005.
